Possession and Fines

  • 30 grams or less : Misdemeanor, 30 Days Incarceration, $500 Max. Fine
  • More than 30 grams : Misdemeanor, 1 Year Incarceration, $5,000 Max.Fine

Requirements to Obtain a Medical Marijuana Card

  • Patient must be under the continuing care of a physician who is registered with the Department of Health.
  • Patient must include a signed certification by the physician stating that the patient has a serious medical condition.

Sale

  • Distribution of less than 30g without remuneration : Misdemeanor, 30 Days Incarceration, $500 Max. Fine
  • Sale of less than 100lbs : Felony, Up to 3 years Incarceration; and $25,000 fine or more with prior drug conviction
  • Sale of 2-10lbs : 1 Year Incarceration, $5,000 Fine; Doubled if conviction is a second or a subsequent drug offence or if the sale is to a minor.
  • Sale of more than 1000 lbs : Felony, Max. Penalty of 10 Years Incarceration and $100,000 Fine; Doubled if conviction is a second or a subsequent drug offence or if the sale is to a minor.
  • Delivery of Marijuana within 1000 ft of a school or 250 ft of a recreational playground : 2-4 Years in prison
  • Distribution to minors by one over the age of 21 : Felony; Applicable penalties doubled

Cultivation

  • Growing marijuana, with or without intention to sell : Felony, Up to 5 years incarceration and $15,000 fine
  • Possession with intent to deliver less than 10 plants : Felony

Driving Under the Influence of Marijuana

  • State has drugged driving law forbidding drivers from operations mototr vehicles if they have a detectable level of an illicit drug or drug metabolite (i.e., compounds produced from chemical changes of a drug in the body, but not necessarily psychoactive themselves) present in their bodily fluids above a specific, state-imposed threshold
  • First Offence : Misdemeanor, 3 Days-6 Months Incarceration; $1000-$5,000 Fine; Required alcohol highway safety school; License suspension of minimum 18 months; Up to 150 hours community service; Required attendance of Victim Impact Panel
  • Second Offence : Misdemeanor, 90 Hours-6 Months Incarceration; Minimum $1,500 Fine; Required alcohol highway safety school; License suspension of minimum 18 months; Up to 150 hours community service; Required attendance of Victim Impact Panel
  • Third and subsequent offense : 2nd Degree Misdemeanor, Minimum 1 year Incarceration, Minimum $2,500 Fine; License suspension of minimum 18 months; Up to 150 hours community service; Required attendance of Victim Impact Panel

Hash & Concentrates

  • Hashish and THC concentrates are Schedule I drugs
  • Less than 8g of Hashish or concentrates : Misdemeanor, Max. 30 days Incarceration and/or Max. $500 Fine
  • More than 8g of Hashish or concentrates : Misdemeanor, Max. 1 year Incarceration Or Max. $5,000 Fine
  • Manufacturing : Felony, Max. 5 years Incarceration, and/or Max. $15,000 Fine; Subsequent convictions : Max. 10 years Incarceration, and/or Max. $30,000 Fine

Paraphernalia

  • Possessing, Manufacturing, Sale or Advertisement of Sale : Misdemeanor, Max. 1 year Incarceration; Max. $2,500 Fine. These Penalties are more severe if Sold or Delivered to Minor

Miscellaneous

  • The department shall suspend the operating privilege of any person upon receiving a certified record of the person’s conviction of any offense involving the possession, sale, delivery, offering for sale, holding fr sale or giving away of any controlled substance under the laws of the US, this Commonwealth or any other state. (1st offense six months, 2nd one year, 3+ two years)
